How are energy brokers mis-selling?

Did your energy broker ever reveal the total amount they earned from setting up your business contract? In our experience, most don’t – and there’s usually a clear reason why. Brokers are well aware that if they were fully transparent about their earnings, they wouldn’t be able to secure the same level of commissions. After all, would you agree to a deal if you knew a significant portion of your bill was lining your broker’s pockets?

Some brokers might have even claimed that their service was free or that they were paid a commission by the supplier as an “introducer’s fee” or something similar. In reality, most brokers receive their commission from the supplier they pair you with, and it’s factored into the unit rate they negotiate for you. Often, this crucial detail is not shared with the customer.

These are the most common comments we receive around Energy Broker mis-selling

This is often true, but it doesn’t necessarily mean you don’t have a claim. In many cases, a broker might save you money compared to your previous costly deal, yet there could still be a significant amount of hidden commission, which may entitle you to a claim.

Brokers often encourage clients to opt for longer-term contracts, suggesting that market prices are likely to rise during that period. However, brokers are incentivised to push these contracts as their commission increases with the contract length, which often results in a higher claim amount.

Unfortunately, energy brokers are not currently regulated, and OFGEM doesn’t have the authority to oversee them at this time. We are urging bodies like OFGEM and Citizens Advice to introduce a code of practice and bring regulation to the industry. In the meantime, we’re working to secure financial compensation for businesses that have been mis-sold to.

Due to the misrepresentations that brokers can make and the ways they can mislead, even the most savvy finance directors and teams can end up being mis-sold to.
